ACLU Looks To Reinstate Fired Walmart Employee Lawsuit

In February a District Court Judge dismissed the lawsuit of Joseph Casias, the Michigan medical marijuana patient who was fired by Walmart for failing a drug test. Now the ACLU is asking the U.S. 6th Circuit Court of Appeals to reinstate Joseph’s lawsuit.
The argument goes to the heart of Michigan’s medical marijuana law and whether or not it protects patients in the workplace. A former Employee of The Year, Joseph suffers from a brain tumor and sinus cancer, but was fired by Walmart for testing positive for the cannabis he uses legally to manage his pain.

Not only will the case have reverberations in Michigan, but across the country as well. Precedents can set, and future medical marijuana bills will have sections about medical cannabis in the workplace based on this case.
