Medical marijuana grower charged after illegally selling pot

Police arrested a registered medical marijuana grower Wednesday after they say he grew too much and was selling it to non-cardholders near an elementary school.

Police arrested Phuoc Din Tran, 41, on charges of unlawful manufacture, distribution and possession of a controlled substance (marijuana). Police seized 4.5 pounds of dried marijuana, 42 live marijuana plants, four guns and more than $7,000 in cash from Tran’s home.

The arrest stemmed from an incident when detectives from the Westside Interagency Narcotics Team (WIN) served a search warrant at 3560 NW Ashland Court in the community of Bethany where Tran lives. Tran is a registered grower and caregiver with the Oregon Medical Marijuana Program, meaning that he can grow a limited amount of marijuana for only those patients specifically identified on his grower’s card. He is not allowed to sell marijuana for profit under any circumstances.

Detectives obtained evidence Tran had been selling marijuana to unregistered people. He has also been illegally selling marijuana out of his house, which is less than 1,000 feet from Bethany Elementary School. Selling near a school can increase the sentence he receives if he is convicted.
